By accessing or using Focus Rise ("the Service"), operated by Shape.tech, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service.

2. Description of Service

Focus Rise is a productivity and focus timer application that allows users to:

  • Create and manage daily tasks
  • Use Pomodoro technique timers for structured work and break sessions
  • Track focus levels and productivity analytics
  • Unlock achievements and build consistency streaks
  • Customize timer settings and preferences

The Service helps users improve productivity through structured time management and focus tracking.

3. Pricing and Payment

Focus Rise is currently free to use. We reserve the right to introduce paid features or subscription plans in the future. If we do so, we will provide advance notice and any changes will not affect existing free functionality without your consent.

4. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Responsibilities

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload false, misleading, or fraudulent information

You may not upload content that:

  • Contains malware or harmful code
  • Violates any person's privacy rights

7. Intellectual Property

The Service, including its design, features, and content (excluding user-created content), is owned by Shape.tech and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

The Focus Rise name, logo, and branding are trademarks of Shape.tech.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Account Deletion

You may delete your account at any time through the app settings or by contacting us. Upon deletion:

  • Your account will be permanently deactivated
  • All associated data will be deleted within 30 days
  • All task history, timer sessions, and analytics will be removed
  • This action cannot be reversed

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • Results from using the Service will be accurate or reliable
  • Any errors will be corrected

11. Limitation of Liability

To the maximum extent permitted by law, Shape.tech and its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Any damages arising from your use of or inability to use the Service

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us (if any) in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless Shape.tech from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of any third-party rights
  • Content you create or upload to the Service

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
